This Temporary Employment Contract is between you, a temporary employee who completes the New Employee Form, and the Giggle Dam Dinner Theatre Ltd. (the “Giggle Dam”) for a limited period of time, starting on your commencement date and ending on November 1, 2021.
Each employee will be paid a contract rate for their services, which assumes $16.50 an hour as a base wage for each Scare Actor and Event Staff person. Security and Creative have varying rates, which must be confirmed in writing, otherwise, the standard rate will apply. The total contract amount for Scare Actor and full-time employees who work 8 hours per day through the event run is $3,696.00.
The Giggle Dam will pay, as an inducement to you for entering into the contract, and advance under the contract equal to approximately 70% of your anticipated wages (not including the bonus as defined below). This inducement is at our option and may vary from employee to employee.
Each employee can qualify for a bonus of up to $500 for their participation in the Vancouver Horror Nights event. To qualify for the bonus, you must attend all training and scheduled shifts on time and without fail. You must follow the directions given to you by the staff, and adhere to all training provided to you. A bonus is not a right, it’s a thank you for your good performance in your role. Your manager will decide, together with the management team, if you have qualified for the full bonus, a reduced bonus, or no bonus at all based on this performance.
Each employee is expected to do anything when asked. All temporary employees will be paid by cheque, unless they are regular employees of the Giggle Dam Dinner Theatre Ltd. and are already on our direct deposit system, in that case, such further and other payments will be made by direct deposit, including the bonus if any.
The Giggle Dam Dinner Theatre Ltd. will reduce your contract payment should you fail to attend a shift, be cut from a shift, or for any other reason where you did not perform your duties for the full night of the attraction. The amount of the reduction shall be $16.50 per hour multiplied by the number of hours you were absent from the attraction while in operation. We may also not schedule you for several days if you work in events, creative, or if you are a part-time scare actor and as a result, your contract payment will be reduced to coincide with the hours you were absent from the production for any reason. We may still pay your full inducement and reduce your wages subsequently after totaling your actual hours worked on your final cheque.
Each payment will include the standard deductions taken from any employee in accordance with the TD1 form you complete on our Workforce system when you become a temporary employee.
The Giggle Dam Dinner Theatre Ltd. reserves the right to cancel this agreement for any reason, or for no reason, including, but not limited to, and order by the Provincial Health Officer.
Neither the temporary employee or the Giggle Dam Dinner Theatre Ltd. will be held liable for any failure to perform its obligations under this Agreement where such breach is due to any of the following: acts or regulations of public authorities, labour difficulties or strike, inclement weather, issues related to COVID-19, epidemic, interruption or delay of transportation service, acts of God, or any other legitimate cause beyond the reasonable control of the temporary employee and the Giggle Dam.
Sickness and Accidents
The temporary employee agrees to meet its obligations under this Agreement subject to legitimate incapacity by sickness or accident.
The temporary employee will not be permitted to display or offer for sale CDs, tapes, and other items at the event and may not offer for sale through any online means such things in connection with the event unless specifically authorized in writing to do so.
The temporary employee will perform exclusively for The Giggle Dam Dinner Theatre Ltd. throughout the actual period of services of this Agreement, which is the entire month of October 2021, unless otherwise provided by The Giggle Dam Dinner Theatre Ltd. in writing. The temporary employee at the time of signing this Agreement will not be under any contract to a third party that might preclude the temporary employee from fulfilling the requirements of this Agreement.

No pyrotechnic devices will be allowed during the event. Violation of this provision will result in immediate cancellation of the Performance and this Agreement.
This Agreement will be governed by, and construed in accordance with, the laws of the Province of British Columbia. The Giggle Dam Dinner Theatre Ltd. and the temporary employee each submit to the jurisdiction of the courts of the Province of British Columbia for the enforcement of this Agreement or any arbitration award or decision arising from this Agreement.
Mediation and Arbitration
If a dispute will arise under the terms of this Agreement, the party claiming the dispute will have ten days to notify the other party. The party not claiming the dispute will have 30 days to remedy the dispute. In the event that the dispute is not remedied within this time period, then any party at its option will have 10 days to submit the dispute to mediation in accordance with any statutory rules of mediation. If mediation is not successful in resolving the entire dispute, any outstanding issues will be submitted to final and binding arbitration in accordance with the statutory rules of that program. If such services are not available, the dispute will be submitted to arbitration in accordance with the laws of the Province of British Columbia. The arbitrator’s award will be final, and judgment may be entered upon it by any court having jurisdiction within the Province of British Columbia.
Covenant of Good Faith and Fair Dealing
The Giggle Dam Dinner Theatre Ltd. and the temporary employee agree to perform their obligations under this Agreement, in all respects, in good faith.
Time is of the essence in this Agreement.
This Agreement will be executed by completing the New Employee Form and by indicating “I agree” on such form, which will serve as a digital signature.
No part of the Performance may consist of acts in violation of any local laws, codes, statutes, ordinances, regulations, rules or any other requirements including building and fire regulations. If the temporary employee violates this section, The Giggle Dam Dinner Theatre Ltd. may immediately cancel the Performance and this Agreement.
The temporary employee’s representative warrants that by signing this Agreement it has the authority to bind the temporary employee to the terms and conditions of this Agreement.
Headings are inserted for the convenience of the parties only and are not to be considered when interpreting this Agreement. Words in the singular mean and include the plural and vice versa. Words in the masculine gender include the feminine gender and vice versa. Words in the neuter gender include the masculine gender and the feminine gender and vice versa.
If any term, covenant, condition or provision of this Agreement is held by a court of competent jurisdiction to be invalid, void or unenforceable, it is the parties’ intent that such provision be reduced in scope by the court only to the extent deemed necessary by that court to render the provision reasonable and enforceable and the remainder of the provisions of this Agreement will in no way be affected, impaired or invalidated as a result.
This Agreement contains the entire agreement between the parties and cannot be changed except by written instrument subsequently executed by the parties to this Agreement. All negotiations and understandings have been included in this Agreement. Statements or representations which may have been made to The Giggle Dam Dinner Theatre Ltd. by the temporary employee, or to the temporary employee by The Giggle Dam Dinner Theatre Ltd., in the negotiation stages of this Agreement may in some way be inconsistent with this final written contract. All such statements are declared to be of no value in this Agreement. Only the written terms of this Agreement will bind the parties.
This Agreement and the terms and conditions contained in this Agreement apply to and are binding upon the temporary employee’s successors, assigns, executors, administrators, beneficiaries, and representatives, and The Giggle Dam Dinner Theatre Ltd.’s successors and assigns.
Any notices or delivery required here will be deemed completed when hand-delivered, delivered by agent, or seven days after being placed in the mail, postage prepaid, to the parties at the respective addresses contained in this Agreement or as the parties may later designate in writing.
