In these Vancouver Horror Nights Entertainment Inc
(“VHN”) the following terms with initial capital letters have the meanings given:

“Vancouver Horror Nights” and “VHN” means Vancouver Horror Nights Entertainment Inc., a body corporate, incorporated pursuant to the laws of the Province of British Columbia.

Terms and Conditions: these general terms and conditions of VHN, as well as other terms like our General Ticket Terms.

Event, Show, or Performance: the organized event, such as an event of a musical, cultural, special and/or recreational nature for which the VHN sells Tickets;

Event Holder: the natural person who or legal entity that produces or organizes an Event and is responsible for it;

Ticket Holder: the natural person with whom or legal entity with which VHN enters into a contract concerning an Event or to whom or which VHN makes an offer
for the purpose of doing so;

Contract: the contract between the VHN and the Ticket Holder for the acquisition of Tickets for Events;

Ticket: the document that serves as an admission ticket for an Event, including an electronic Ticket;

Parties: The Ticket Holder and VHN together.

Applicably of the VHN Terms & Conditions
These Terms & Conditions apply to all offers, orders, legal relationships and contracts pursuant to which the VHN provides products or services of any nature whatsoever to the Customer, also if these products or services are not described or not further described in these General Terms and Conditions.

Where the VHN has entered into a booking or other agreement with any entity, person, or Ticket Holder, these Terms & Conditions shall be incorporated by reference and apply to all purchases.

The VHN expressly rejects other conditions of the Ticket Holder.

The parties may only agree to changes in relation to the Terms & Conditions in writing. The VHN is entitled to change the Terms & Conditions and declare changed Terms & Conditions applicable to Contracts. Changed Terms & Conditions shall be published on VHN’s website for consultation, located at https://vancouverhorrornights.com/.

The Terms & Conditions of the Event Holder of the Event shall likewise apply to the Contract. If the Customer does not yet have a copy of the Event Holder’s general terms and conditions, the Event holder shall send on request the Event Holder’s general terms and conditions.

The Ticket Holder of a valid ticket is admitted to VHN on the condition that the Ticket Holder agrees, and by use of the ticket does so agree in favour of the producer and the property owner, to the following terms and conditions. Any violation of these terms will entitle VHN to, as applicable, seize or cancel the ticket, withdraw the license granted below, refuse admission and/or expel a Ticket Holder, in each case without payment of any refund or other compensation.

The ticket is a personal, revocable license. Lost, stolen or destroyed tickets will not be honoured. Tickets may not be resold or offered for resale by anyone without the permission of VHN and may not be resold at a price exceeding their face value at any time, unless the tickets are being used for a charity auction or other approved use, specifically approved by VHN in writing. Likewise, a ticket holder agrees not to purchase resold tickets for any reason or at any time.

The ticket may not be used for advertising, promotion or for any other trade purposes without our express written permission.

Tickets obtained from any source other than VHN, such as Viator, Fly Over Canada, Cougar Creek House of Horrors, Groupon, Expedia, Google Tickets or their authorized agents may be lost, stolen or counterfeit tickets and may not be honored.

The license may be withdrawn and admission refused at any time upon refunding the printed purchase price, including in the event of cancellation of the Performance. Performances may be canceled or reschedule at any time, with or without notice, at the sole discretion of the VHN.

Any person entering the attraction, regardless of age, must hold a valid ticket.

VHN welcomes all registered and identifiable Service Animals. Due to the nature of our food and beverage services provided and for the safety of everyone, all pets are prohibited from entering the attraction at any time.

A Ticket Holder must ensure that the Ticket Holder and any minors or others for whom the Ticket Holder is responsible conduct themselves appropriately and in a manner which is not determined by VHN or its representatives to be objectionable or disturbing to other patrons.

Restricted and Prohibited Items
The following items are restricted, may not be brought into the attraction and may be confiscated by VHN staff: outside beverages of any kind, illegal drugs, weapons of any kind, bottles, cans, food products purchased outside VHN. We also restrict your ability to bring in commercial audio/video/image recording or transmitting devices without our consent. We want to make sure you get our good side, so if you want photos of your experience, we recommend you purchase our PhotoPass service. We reserve the right at any time to limit or ask you to stop recording. We respect everyone and want everyone to have a good time, please keep that in mind when recording others who are not part of our shows. The Ticket Holder consents to a reasonable examination of the Ticket Holder’s person and belongings to ensure compliance with these terms.

Audio / Video / Image Recording Allowed Inside Our Attractions
There is to be no video or audio recording inside our haunted attractions.

Grant of License to Record
The Ticket Holder grants to VHN a fully-paid, perpetual right to all photographs, video or audio recordings of the Ticket Holder taken or made at the Performance and the right to record, use, reproduce, broadcast, sell and distribute any photographs, video or audio recordings for any purpose.

All Programs Subject to Change
All artists, shows, events, attractions, and programs or program portions are subject to change. Due to the nature of live Performance, VHN does not warrant that the Ticket Holder will be satisfied with the performance or that it will be free of technical difficulties.

Tickets are Non-Refundable / Ticket Reassignment / Changing Dates
​We are unable to offer refunds on any purchase. If you would like to reschedule your ticket time slot, you will need to purchase VHN ticket insurance. Ticket insurance allows you to reschedule your date and assigned time slot one time and confers no other benefits. In the event that the Provincial Health Officer imposes restrictions that limit or cancel our event, you agree that your tickets will carry forward to the next available dates we are permitted to operate. If our event is canceled by restrictions imposed by the Provincial Health Officer, or for any other reason, you expressly agree that your tickets will transfer to next year.

​VHN publishes rules on its website, which are updated from time to time. Each Ticket Holder agrees that they will abide by and follow all Rules of VHN. There may be attraction specific rules that are communicated to you when you enter an attraction and are delivered verbally. By proceeding into the attraction, you agree to these rules as well. Failure to abide by the Rules will result in your immediate ejection from the Event of Performance, without a refund.

Chickening Out
​VHN is a haunted attraction — you’ve paid us to scare you. If the experience becomes too intense for you, you may advise the nearest Cast Member that you wish to “chicken out” and you’ll be allowed to leave the attraction through defined “chicken doors” to immediately exit to the main area of the Scream Park. Chicken doors are marked with a sign and are normally a black curtain that is easy to move through. If you do “chicken out,” you will not be provided with a refund. You will, however, be immortalized on our chicken counter, which counts the number of guests who chicken out each year.​

You Assume All Risks
The Ticket Holder voluntarily assumes all risk and danger of personal injury and hazards arising from or related in any way to the Performance, whether occurring prior to, during or after the Event and releases VHN from all liability. Our attraction employs the use of strobe-type lights, fog machines, use means of guest restraint, require the use of blindfolds in certain attractions, employ a very loud sound system, and operates in low-light conditions. If you have any conditions that could be affected by these elements of our show, you should not attend the Performance or Event.

Our Liability to You is Extremely Limited
In the event the VHN is found liable for damages of any kind, the Ticket Holder and VHN expressly agree that damages shall be limited to the individual ticket price of the Ticket Holder or $500, whichever is less.

COVID-19 Specific Terms
I acknowledge the contagious nature of the novel Coronavirus (“COVID-19”) and that the BC CDC and many other public health authorities still recommend practicing social distancing.
I acknowledge that VHN recommends that I wear a mask at all times while on the grounds of the Event.
I further acknowledge that VHN can not guarantee that I will not become infected with COVID-19. I understand that the risk of becoming exposed to and/or infected by COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, VHN staff, and other VHN Ticket Holders and their families.

I voluntarily seek services provided by VHN and acknowledge that I am increasing my risk to exposure to COVID-19. I acknowledge that I must comply with all set procedures to reduce the spread while attending my appointment.

I attest that:
I am not experiencing any symptoms of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell.I have not traveled outside Canada within the last 14 days.I have not traveled to a highly impacted area within Canada, the United States of America, or any other country in the last 14 days. I do not believe I have been exposed to someone with a suspected and/or confirmed case of COVID-19.I have not been diagnosed with COVID-19 and not yet cleared as non contagious by Provincial or local public health authorities.I am following all BC CDC recommended guidelines as much as possible and limiting my exposure to the COVID-19.I also acknowledge that by entering the VHN on the Performance date that I am re-attesting that all the aforementioned are still true. I understand that there is no fee or charge to rebook my tickets to another scheduled Performance if I present with symptoms of COVID-19. I also agree that the VHN, in its sole judgment, may require that I rebook my tickets to another scheduled performance, or that the VHN may, if entry to the Event is authorized, withdraw that authorization and require that I rebook my Tickets to another scheduled performance.

For the purposes of this Agreement, COVID-19 symptoms are defined as:
Flu-like symptoms; Nausea and/or Vomiting; Headache; Cough; Shortness of Breath or Difficulty Breathing; Chills; Repeated Shaking with Chills; Muscle Pain; Sore Throat; Have a fever, as defined as: in children: 38°C (100.4°F) and above; in adults: 38°C (100.4°F) and above; in older adults: 37.8°C (100°F) and above; or 1.1°C above the Ticket Holder’s usual value; A sudden and unexplainable loss of smell, without nasal congestion; COVID-19 Specific Release

I hereby release and agree to hold VHN harmless from and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses, and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of the attraction, or that may otherwise arise in any way in connection with any services received from the VHN. I understand that this release discharges the VHN from any liability or claim that I, my heirs, or any personal representatives may have against VHN with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from the VHN. This liability waiver and release extends to the VHN together with all owners, partners, and employees.

In addition to these releases, I acknowledge that I must sign a waiver, or complete a waiver on behalf of my minor child, prior to entering the event grounds. Failure to complete a waiver VOIDS your ticket, you must not attend the attraction, and you agree to leave immediately without a refund.

Amicable Negotiation
The Parties agree that, both during and after the Event of their responsibilities under this Agreement, each of them shall make bona fide efforts to resolve any disputes arising between them by amicable negotiations and provide frank, candid and timely disclosure of all relevant facts, information and documents to facilitate those negotiations.

Efficient Process
The Parties further agree to use their best efforts to conduct any dispute resolution procedures herein as efficiently and cost effectively as possible.

The Parties agree to attempt to resolve all disputes arising out of or in connection with this contract, or in respect of any legal relationship associated with it or from it, by mediated negotiation with the assistance of a neutral person appointed by the British Columbia International Commercial Arbitration Centre administered under its Commercial Mediation Rules.

If the dispute cannot be settled within 30 days after the mediator has been appointed, or such other period agreed to in writing by the Parties, the dispute shall be referred to and finally resolved by arbitration administered by the British Columbia International Commercial Arbitration Centre, pursuant to its Rules.

In the absence of any written agreement otherwise, the place of arbitration shall be Vancouver, British Columbia.

This agreement has to be interrupted and applied in accordance with the Laws of the Province of British Columbia.

You Accept These Terms by Purchasing, Holding, or Using a Ticket

By purchasing, using, or holding a ticket, you and all your guests (fellow Ticket Holders) agree to these Terms and Conditions. You agree that you will notify each person in your group of these Terms and Conditions prior to entering the attraction.
